ARTICLE 01 Privacy Policy

Privacy Policy

1.1 — Data Controller. CanvasShiftWorks, located at Rua da Ferreirinha 12, 5050-224 Peso da Régua, Portugal, is the data controller responsible for the processing of personal data collected through this website.

1.2 — Data Collection. We collect personal data voluntarily submitted through contact forms, including: full name, email address, phone number, and project details. This data is collected solely for the purpose of responding to inquiries and delivering requested services.

1.3 — Legal Basis. Processing of personal data is based on Article 6(1)(b) of the GDPR — performance of a contract or pre-contractual measures taken at the data subject's request. Additionally, processing may be based on Article 6(1)(f) — legitimate interest in responding to business inquiries.

1.4 — Data Retention. Personal data is retained for a maximum of 24 months from the last communication. After this period, data is securely deleted from all systems. Contract-related data may be retained for up to 6 years as required by Portuguese tax legislation.

1.5 — Data Sharing. Personal data is not sold, traded, or transferred to third parties except where required by law or necessary for service delivery (e.g., payment processors operating under GDPR-compliant data processing agreements).

1.6 — Data Subject Rights. Under the GDPR, you have the right to: access your personal data (Article 15), rectify inaccurate data (Article 16), request erasure (Article 17), restrict processing (Article 18), data portability (Article 20), and object to processing (Article 21). 1.7 — Security. CanvasShiftWorks implements appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction, in compliance with Article 32 of the GDPR.

ARTICLE 02 Terms of Service

Terms of Service

2.1 — Acceptance. By accessing or using the services provided by CanvasShiftWorks, located at Rua da Ferreirinha 12, 5050-224 Peso da Régua, Portugal, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2.2 — Scope of Services. CanvasShiftWorks provides web design services including but not limited to: website layout design, responsive engineering, visual identity systems, landing page design, e-commerce architecture, information architecture, interaction design, and performance optimization.

2.3 — Project Initiation. All projects begin upon receipt of written confirmation and initial payment as specified in the project proposal. CanvasShiftWorks reserves the right to decline projects at its sole discretion.

2.4 — Pricing & Payment. Prices are quoted in Euros (€) and are fixed for the scope defined in the project proposal. Payment terms: 50% upon project initiation, 50% upon delivery. Late payments incur a 2% monthly surcharge. All prices include applicable Portuguese VAT where required.

2.5 — Intellectual Property. Upon full payment, all design deliverables and associated intellectual property are transferred to the client. CanvasShiftWorks retains the right to display completed work in its portfolio unless otherwise agreed in writing.

2.6 — Revisions. Each project includes two (2) rounds of revisions at no additional cost. Additional revisions are billed at €75/hour. Revisions must be requested within 14 days of deliverable receipt.

2.7 — Limitation of Liability. CanvasShiftWorks shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the total amount paid for the specific service giving rise to the claim.

2.8 — Governing Law. These Terms are governed by Portuguese law. Any disputes shall be resolved in the courts of Vila Real, Portugal.

ARTICLE 03 Cookie Policy

Cookie Policy

3.1 — What Are Cookies. Cookies are small text files stored on your device when you visit a website. They help the site remember your preferences and improve your browsing experience.

3.2 — Cookies We Use. CanvasShiftWorks uses only essential cookies necessary for the functioning of this website. These include:

  • Cookie Consent Cookie — Stores your cookie consent preference. Duration: 365 days. Purpose: Remember your choice regarding the cookie banner.
  • Session Cookies — Temporary cookies that expire when you close your browser. Purpose: Maintain session state during navigation.

3.3 — No Third-Party Tracking. CanvasShiftWorks does not deploy Google Analytics, Facebook Pixel, or any other third-party tracking cookies. No advertising or marketing cookies are used.

3.4 — Managing Cookies. You can manage or disable cookies through your browser settings. Note that disabling essential cookies may impair website functionality. Instructions vary by browser — consult your browser's help documentation.

3.5 — Changes. This Cookie Policy may be updated periodically. Material changes will be communicated via the cookie consent banner upon your next visit.

ARTICLE 04 Refund Policy

Refund & Reimbursement Policy

4.1 — Eligibility. Refund requests are evaluated on a case-by-case basis according to project milestones completed. CanvasShiftWorks, located at Rua da Ferreirinha 12, 5050-224 Peso da Régua, Portugal, commits to fair and transparent refund processing.

4.2 — Cancellation Before Work Begins. If a project is cancelled before any work has commenced, a full refund of the initial payment will be issued within 14 business days.

4.3 — Partial Refunds. If a project is cancelled after work has begun, a partial refund may be issued based on the percentage of work completed. The calculation is as follows:

  • Less than 25% complete: 75% refund of amount paid
  • 25–50% complete: 50% refund of amount paid
  • 50–75% complete: 25% refund of amount paid
  • More than 75% complete: No refund

4.4 — Non-Refundable Items. The following are non-refundable: domain registration fees, third-party licensing costs, and work already delivered and accepted by the client.

4.5 — Refund Process. To request a refund, contact [email protected] with your project reference and reason for the request. Refund requests are processed within 14 business days of approval. Refunds are issued to the original payment method.

4.6 — Dispute Resolution. In the event of a dispute regarding refunds, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedies under Portuguese law.
